APPEARANCE/PUBLICITY RELEASE "ROCK BOTTOMS" SUBMISSIONS 2011 I, , acknowledge that I am the subject of a photograph and I hereby authorize WXNR (“Station”), to use, for whatever purposes it may choose, photographs or videotapes or other audio or visual images or recordings of me supplied by myself or other third parties, including my name and city/state (collectively, the “Likenesses”), without additional financial or other compensation. In consideration of my authorization herein for the recognition of my Likenesses as an entry in the “Rack To School” Contest, and/or the posting of the Likenesses in conjunction with any 995THEX.COM contests, sweepstakes, activities, and features on the website, or television commercials to promote Station (“Uses”) or any other valuable consideration that may be given, I agree to the following: Under no circumstances will Station be held liable or responsible for the authorized or unauthorized display, publication or duplication of the Likenesses. I acknowledge that Station is and shall be the sole and exclusive owner of such postings or recordings of the Likenesses and shall have the right to exploit such postings or recordings, and portions thereof, in any manner and any media whatsoever. I consent to the use, editing, reproduction, exhibit or display of such postings or recordings for advertising and publicity purposes relating to the Uses by Station or its sponsors, or for any other lawful purpose, in any media now known or hereinafter invented, without further notice, permission, or compensation. I hereby assign to the Station, its parent, subsidiaries, affiliates, successors and assigns whatever rights or interest I may now or ever have in the Likenesses or Uses. I understand and accept that the display, publication or duplication of the Likeness may subject me to risk of notoriety, publicity, ridicule, scorn and/or indignity. I understand that there is no guarantee that the Likeness will be included in any website posting or commercials, if any website postings or commercials are in fact produced and/or broadcast. I agree that I will not make any claim, on my behalf, against Station, its affiliates or parent companies, or the officers, shareholders, directors, employees, agents or representatives of any of them or their successor and assigns (collective, the “Released Parties”). I hereby, release, discharge, hold harmless and indemnify the Released Parties from any and all liability for any losses, claims, damages, demands, causes of action, costs or expenses, including reasonably attorneys’ fees, no matter how caused, arising out of or otherwise related to my Likeness, or any breach, or alleged breach by me of any affirmation, undertaking, or obligation of mine in this Publicity Release, or of the use of the Likenesses for any purpose. I understand that this Release is intended to be as broad and inclusive as permitted by law, and I agree that if any portion of this Release is deemed invalid, the remainder will continue in full force and effect. I further understand that this Release is to be interpreted under the laws of the State of NORTH CAROLINA, notwithstanding its conflict of laws provisions, and I submit to the jurisdiction of the courts within and waive all objections to the jurisdiction or venue of such courts.
